Unsolicited Submission Policy

For Creators: Unsolicited Submission Policy

Outside of our Fiscal Sponsorship program and its formal online submission process, Shine Global does not accept or consider unsolicited materials of any kind. To the extent that projects, original ideas, notes, suggestions, comments, concepts or other information sent to Shine Global (collectively referred to as “Materials”), the terms of this policy are set forth below.

The purpose of this policy is to avoid misunderstanding if an original work you send seems similar to a Shine Global produced or supported project. The Materials might duplicate efforts made previously by members of our own staff or by other third parties, or we may have already used Materials similar to the material being submitted which was previously submitted by others, or we may commence using Materials similar to the material being submitted that we receive after the date of such submission.

Please note, if you choose to disregard this provision and submit unsolicited materials, you acknowledge that you have read this provision and you understand that Shine Global has no obligation to you or to your submission, and that you have no claim whatsoever based on such submission.

All Materials shall be deemed and shall remain the sole property of Shine Global and shall not be subject to any obligation of confidentiality on the part of Shine Global. Without limiting the foregoing, Shine Global shall be deemed to own all known and hereafter existing rights of every kind and nature regarding the Materials and shall be entitled to unrestricted use of the Materials for any purpose, without compensation to the provider of the Materials.

GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of New York (United States), excluding any laws that might direct the application of the laws of another jurisdiction. We may store and process Personal Information on servers or on a cloud located in the United States and elsewhere. Any action relating to the content of the Site or these Terms must be brought in the federal or state courts located in New York, New York, and you hereby irrevocably consent to the jurisdiction of such courts.
